123 Cheese Studio — Content Rights & Copyright Policy
Copyright, likeness, upload authority, and output-use rules for customers in the United States, United Kingdom, Australia, Canada, and New Zealand.
Personal, non-commercial use only
Selecting Pay or Unlock confirms that every reference is authorised. You may not use an output commercially or imply a real meeting, relationship, affiliation, or endorsement involving a celebrity, public figure, or politician. You accept responsibility for your submitted material and downstream use, subject to legal obligations that applicable law does not allow either party to exclude.

1. Policy status
This Content Rights & Copyright Policy forms part of the Terms of Service. Selecting Pay or Unlock after receiving a link to this Policy confirms acceptance of it. It is written as a common baseline for customers in the United States, United Kingdom, Australia, Canada, and New Zealand, while preserving mandatory local consumer, privacy, personality, publicity, and intellectual-property rights.
2. Rights in uploaded photographs
You retain the copyright and other rights you already own in an uploaded photograph. Uploading does not transfer ownership to the Studio. You must own the photograph or hold a licence that permits uploading, AI transformation, transmission to contracted processors, and creation of the requested portrait. Permission from the person pictured does not by itself replace permission from the photographer or copyright owner.
3. Likeness and same-person authority
Each face and full-body reference must show the same portrait subject. The subject must be you or a person who expressly authorised the upload and AI portrait creation. A parent or lawful guardian must act for a minor. You may not use another person's body as a shape reference or upload internet, scraped, or unauthorised stock-model images. Images of celebrities, entertainers, athletes, influencers, royals, public officials, candidates, politicians, or other recognisable public figures require documented express authority from that person and every necessary copyright owner and otherwise are prohibited. A lawful copy of a photograph does not by itself grant likeness, personality, publicity, endorsement, or transformation rights.
4. Processing licence
You grant the Studio and its contracted processors a limited, non-exclusive, worldwide licence to copy, resize, transmit, analyse, combine, and transform submitted content only to provide the service, perform quality and safety review, prevent abuse, provide support, and comply with law. This licence does not permit the Studio to sell your likeness or publicly advertise with your private portrait without separate permission.
5. Rights in AI-generated outputs
After a valid paid unlock, the Studio grants the payer a perpetual, worldwide, non-exclusive licence to download, print, and privately display the delivered output solely for lawful personal, household, and non-commercial use. A genuine family portrait may be shared non-commercially only with every depicted person's authority and without a deceptive caption or presentation. No licence is granted for advertising, business or professional profiles, paid or sponsored posts, monetised websites or channels, merchandise, resale, sublicensing, fundraising, political advocacy, campaigns, endorsements, testimonials, brand promotion, or any other direct or indirect commercial advantage. The Studio does not claim ownership of the customer's underlying likeness. Copyright law differs by country, and an output created primarily by AI may not qualify for copyright protection in the United States or elsewhere. The Studio cannot assign copyright that does not legally exist and does not guarantee exclusivity or copyright registration.
6. Customer responsibility after payment
Payment confirms that you accept responsibility for the legality of submitted references and for every later use, edit, caption, publication, print, sale, licence, or distribution of the output. Payment does not buy another person's consent, copyright, publicity or personality rights, endorsement, or permission to publish, and there is no option to convert this personal-use licence into a commercial licence. You are responsible for third-party claims and losses reasonably caused by your unauthorised content, false statement of authority, deceptive caption, public-figure composite, false endorsement, impersonation, political use, commercial exploitation, or other downstream breach. To the fullest extent permitted by applicable law, you must reimburse the Studio for reasonable, documented losses and defence costs directly caused by that breach. This allocation does not excuse the Studio's own unlawful conduct or remove a non-waivable consumer right.
7. Prohibited content and uses
You may not use the service or an output for impersonation, fraud, false endorsement, defamation, harassment, intimate or sexual imagery, child exploitation, political deception, voter manipulation, identity verification, evasion of security controls, discrimination, or infringement of copyright, trademark, privacy, publicity, passing-off, moral, or personality rights. You must not state or imply that you met, photographed, know, work with, are affiliated with, or are endorsed by a public figure when that is untrue, including through a caption, blog post, social-media post, advertisement, thumbnail, dating profile, fundraising page, or monetised channel. A synthetic portrait must never be presented as proof that a meeting, relationship, endorsement, testimonial, or depicted event occurred. If an unauthorised public-figure output is produced despite safeguards, it may only be retained privately as evidence for a complaint and may not be posted, shared, sold, or otherwise exploited.
8. Copyright and likeness complaints
A rights holder may contact the Studio with identification of the work or person, the disputed material or session, contact information, a good-faith explanation of the claimed right, and a statement that the report is accurate. We may restrict access, preserve evidence required by law, request supporting documents, notify the customer, or remove material while reviewing a report. US copyright notices may also be handled under the Digital Millennium Copyright Act when applicable.
9. Regional rights
Nothing in this Policy removes non-waivable rights or remedies. In the United States, relevant law includes federal copyright, trademark, unfair or deceptive-practices law and state publicity, digital-replica, privacy, false-light, defamation, and consumer law; for example, California Civil Code section 3344 addresses knowing unauthorised commercial use of a person's name, voice, photograph, or likeness. In the United Kingdom, protection may arise under the Copyright, Designs and Patents Act 1988, UK GDPR, Data Protection Act 2018, defamation, misuse of private information, passing off for false endorsement, the Consumer Rights Act 2015, and the Digital Markets, Competition and Consumers Act 2024. In Australia, relevant law includes the Copyright Act 1968, Privacy Act 1988, defamation, passing off, moral rights, and the Australian Consumer Law prohibition on misleading or deceptive conduct. In Canada, relevant law includes the Copyright Act, Competition Act sections 52, 74.01 and 74.02, PIPEDA or substantially similar provincial law, passing off, defamation, consumer law, and provincial personality or privacy rights. In New Zealand, relevant law includes the Copyright Act 1994, Privacy Act 2020, Defamation Act 1992, Fair Trading Act 1986, Consumer Guarantees Act 1993, and passing off. The exact claim and remedy depend on the facts and jurisdiction.
10. Studio limitation
To the fullest extent permitted by applicable law, the Studio is not liable for disputes, claims, loss, or damage caused by a customer's lack of authority, false representation, unauthorised upload, deceptive caption, public-figure composite, false endorsement, prohibited use, commercial exploitation, or publication of an output. This is an allocation of customer-caused risk, not a promise of absolute immunity. The Studio remains responsible for obligations that cannot legally be excluded, including applicable consumer guarantees, reasonable-care duties, privacy and data-protection duties, and liability for its own fraud, wilful misconduct, unlawful processing, or other non-excludable conduct.
This Policy preserves rights that cannot be waived under applicable consumer, copyright, privacy, and personality-rights laws. Market-specific legal review remains required before production launch.
